1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and Yes Auto Canada (“we,” “our,” or “us”), a company headquartered at Unit 300, 10216 124 Street NW, Edmonton, AB, T5N 4A3, operating the website www.yesautocanada.ca. By accessing our website, submitting an application, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our website or submit any information through our application forms. By submitting an application through our website, you are providing express consent to the collection, sharing, and use of your personal information as described in these Terms and our Privacy Policy, including the transfer of your information to our authorized dealer and lender partners.
2. Nature of Our Service
IMPORTANT — PLEASE READ CAREFULLY: Yes Auto Canada is a lead generation and referral service. We are not a lender, dealer, bank, credit union, or financial institution. We do not directly provide vehicle financing, approve or deny credit applications, set interest rates, or sell vehicles. Our service operates as follows:
- Application Collection: We collect your personal and financial information through our secure online application form.
- Information Transfer: We share your application information with one or more of our authorized dealer partners and/or lender partners (“Partners”) who may be able to assist you with vehicle financing.
- Partner Contact: Our Partners will contact you directly to discuss financing options, obtain credit bureau reports, evaluate your application, and facilitate the financing and vehicle purchase process.
- No Guarantee: Submitting an application through our website does not guarantee financing approval, a specific interest rate, specific loan terms, or access to any particular vehicle. All financing decisions are made solely by our Partners and their affiliated lenders at their discretion.
We act solely as an intermediary connecting prospective vehicle buyers with dealer and lender partners. Any financing agreement you enter into is between you and the applicable dealer or lender, not Yes Auto Canada.
3. Consent to Share Information with Partners
By submitting an application through our website, you expressly consent to the following:
3.1 Transfer of Your Information: You consent to Yes Auto Canada sharing, transferring, and providing your personal information — including your name, contact information, financial details, employment information, residency information, and any documents you upload — to one or more of our authorized dealer and lender partners for the purpose of evaluating your vehicle financing options.
3.2 Credit Bureau Inquiries: You consent to our authorized dealer and lender partners obtaining your credit report and credit score from one or more Canadian credit bureaus, including Equifax Canada and TransUnion Canada. You understand that these inquiries may appear on your credit report and may be classified as “hard inquiries” that could temporarily affect your credit score. The number of inquiries will depend on how many partners evaluate your application, which is determined by the partners, not by Yes Auto Canada.
3.3 Partner Contact: You consent to being contacted by Yes Auto Canada and/or our authorized dealer and lender partners via telephone (including automated or pre-recorded calls), text message (SMS/MMS), email, and/or mail at the contact information you provide in your application. This contact may be for purposes related to your financing application, including follow-up, financing offers, and related vehicle sales opportunities. You understand that message and data rates may apply for text messages and that you may opt out of text communications by replying STOP at any time.
3.4 No Control Over Partner Decisions: You understand and acknowledge that Yes Auto Canada has no control over and assumes no responsibility for the decisions, actions, or practices of our dealer and lender partners, including their credit evaluation criteria, interest rates offered, financing terms, vehicle availability, or customer service. Any disputes relating to financing terms, vehicle quality, or dealer conduct must be resolved directly with the applicable partner.
4. Eligibility
- Be at least 18 years of age (or the age of majority in your province of residence)
- Be a resident of Canada or legally authorized to reside and work in Canada
- Possess a valid Canadian driver’s licence or be in the process of obtaining one
- Provide accurate, truthful, and complete information in your application
- Have the legal capacity to enter into a binding agreement
By submitting an application, you represent and warrant that you meet all of the above eligibility requirements and that all information provided is true, accurate, and complete to the best of your knowledge.
5. Accuracy of Information
You are solely responsible for ensuring that all information you provide in your application is accurate, complete, and up to date. Providing false, misleading, or incomplete information may result in: Denial of your financing application by our Partners; Termination of any financing arrangement obtained through false information; Legal consequences, including potential civil or criminal liability for fraud.
Yes Auto Canada is not responsible for verifying the accuracy of the information you provide. Verification is conducted by our dealer and lender partners as part of their independent evaluation process.
6. No Warranties or Guarantees
OUR WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Without limiting the foregoing, we make no representations or warranties regarding: The likelihood that you will be approved for vehicle financing; The interest rates, terms, or conditions of any financing offer you may receive; The quality, safety, legality, or availability of any vehicle; The conduct, reliability, or creditworthiness of any dealer or lender partner; The accuracy of any information displayed on our website, including but not limited to descriptions of programs, timelines, or processes; The uninterrupted or error-free operation of our website.
Any statements on our website regarding “fast response times,” “24-hour response,” or similar language are aspirational and not guaranteed. Actual timelines depend on partner availability, application volume, and other factors outside our control.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YES AUTO CANADA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR: Any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or services; Any actions, decisions, or conduct of our dealer or lender partners; Any financing terms, interest rates, fees, or charges imposed by any lender; Any loss or damage resulting from unauthorized access to your personal information, except to the extent caused by our gross negligence; Any loss of data, revenue, profits, or business opportunities.
In no event shall our total aggregate liability to you for all claims arising from or related to these Terms or our services exceed the amount of fifty Canadian dollars (CAD $50.00). Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.
8. Indemnification
You agree to indemnify, defend, and hold harmless Yes Auto Canada, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: Your use of our website or services; Your breach of these Terms; Any inaccurate, misleading, or fraudulent information you provide; Your violation of any applicable law or regulation; Any dispute between you and a dealer or lender partner.
9. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, icons, photographs, software, and the compilation thereof, is the property of Yes Auto Canada or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws. The Yes Auto Canada name, logo, and all related brand marks are trademarks of Yes Auto Canada. You may not use, reproduce, modify, distribute, or display any of our trademarks or copyrighted materials without our prior written consent.
10. Prohibited Uses
- Submit false, fraudulent, or misleading information
- Impersonate another person or entity
- Attempt to gain unauthorized access to our systems, databases, or networks
- Interfere with or disrupt the operation of our website
- Scrape, harvest, or collect data from our website without our written consent
- Use our website for any purpose that is unlawful or prohibited by these Terms
- Submit applications on behalf of another individual without their knowledge and consent
- Upload malicious code, viruses, or any other harmful technology
11. Communications Consent (CASL Compliance)
By submitting an application, you provide your express consent under Canada's Anti-Spam Legislation (CASL) to receive commercial electronic messages from Yes Auto Canada and from our authorized dealer and lender partners, including: Application status updates and notifications; Financing-related offers and information from Yes Auto Canada and our partners; Marketing communications about our services and partner offers; Newsletters and educational content related to vehicle financing and credit; Vehicle inventory, promotions, and financing offers from the dealer and lender partners we share your application with.
You may withdraw your consent and unsubscribe from marketing communications at any time by clicking the “unsubscribe” link in any email, replying STOP to any text message, or contacting us at info@yesautocanada.ca. Please note that even after unsubscribing from marketing communications, we may still send you transactional messages related to your application.
12. Dispute Resolution
12.1 Disputes with Yes Auto Canada: Any dispute, controversy, or claim arising out of or relating to these Terms or our services shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of the Province of Alberta.
12.2 Disputes with Partners: Any disputes relating to vehicle financing, vehicle quality, dealer conduct, financing terms, interest rates, or any other matter involving our dealer or lender partners must be resolved directly between you and the applicable partner. Yes Auto Canada is not a party to any agreement between you and a partner and bears no responsibility for resolving such disputes.
13. Termination
We reserve the right to refuse service, terminate accounts, or cancel applications at our sole discretion, without notice, for any reason, including but not limited to: Violation of these Terms; Submission of false or fraudulent information; Abusive or threatening behavior toward our staff or partners; Suspected fraudulent activity.
Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6, 7, 8, 9, and 14.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of the Province of Alberta for the resolution of any disputes arising from these Terms.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yes Auto Canada with respect to your use of our website and services. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
